Hong Kong finalises crypto regulatory framework to lock in global hub ambitions
Framework finalised
Hong Kong has completed a long‑anticipated regulatory framework for the digital‑asset industry as it pursues a bid to become a global crypto hub. The Financial Services and the Treasury Bureau (FSTB, 財經事務及庫務局) and the Securities and Futures Commission (SFC, 證監會) said the proposals drew broad support; it has been reported that the package will be sent to the Legislative Council later this year. SFC chief executive Julia Leung Fung‑yee described the consultation’s conclusion as the “final leg” of building a full regulatory regime for digital assets.
New rules and requirements
The rules model many requirements on existing securities frameworks and impose strict capital, compliance and client‑protection measures. Firms that only provide market advice or analysis and do not hold client assets must keep at least HK$100,000 (US$12,762) in liquid capital; firms holding client assets must maintain a minimum HK$5 million in paid‑up share capital and HK$3 million in liquid capital. Advisory and asset‑management firms will also need robust know‑your‑client (KYC) processes, must administer virtual‑asset knowledge assessments to clients, and face tightened marketing restrictions targeted at the Hong Kong public.
Context and implications
The move underscores Hong Kong’s strategy to attract exchanges, custodians and asset managers that have left or bypassed mainland China — where retail crypto trading and mining have been tightly restricted — and to compete with regional hubs such as Singapore. But will regulatory clarity be enough? Global investors and platforms are watching not just the capital and compliance thresholds but how Hong Kong navigates cross‑border issues, evolving US and EU crypto rules, and geopolitical frictions that have complicated tech and finance flows. Reportedly, the goal is to balance investor protection with market openness; achieving both will determine whether Hong Kong can translate policy ambition into sustained market leadership.
